Default EU1 - Unmarried Partner

I know that Ireland must consider the unmarried partner of an EU national as they now recognise defacto relationships. I'm getting ready to submit my application.

My situation:
I've been in Ireland on and off for over 2 years. I'm American and my partner is Dutch (she's been living in Ireland since she was 12). We've been together for 2+ years, but we've only been on the same lease for 1 year 2 months. I was not on the previous lease, although I resided with her. I couldn't be out on the lease as I was here as a visitor and didn't have a PPS number. I do have post dating back to May 2008. If I can find it, I may have post from vodafone (I was pre-pay) at that address dating back to Jan 2008. She has recently lost her job, but has started to go freelance. However, she currently isn't registered for self-employment. It's too late to get that letter as we need to submit the application asap as my current permit expires at the end of Feb 2010. She has enough funds to prove she is self-sufficient.

We both have insurance cards. Do we just send a copy of the card?

We are both writing letters, as are her parents and a friend of ours. We really only need the visa til June/July 2010 as we'll be moving to the UK for me to study. We can't move before June 2010 as our lease doesn't expire til 8 June 2010. Plus, I've heard that they are really strict on the EEA2 app, though I can stay as a visitor for 6 months.

Does anyone know if what we have will suffice? How long will the EU1 application take? I've noticed that those applying for a stamp4 through the defacto relationship with an Irish national have been receiving a reply within 2-4 weeks. I'm just worried that if we are refused, I have nowhere to go. As long as we receive acknowledgement and I'm given a stamp to remain (I don't need a work permit as I freelance through the US) we'll be fine. We just need something to tie us over til June/July.

Any thoughts? Thanks in advance.

If you can prove that you are financially self sufficient and carry adequate private medical insurance why not just seek permission to remain in Ireland until June 2010? What is your current status?

As for breaking your lease, I would not worry too much about that - I have yet to hear of a landlord taking a tenant to court for breaking a lease. Be prepared to lose your deposit but you will not be dragged through the civil courts.

We are living with some friends, another couple, and all of us are on the lease, so there is not way we can break the lease a we would be leaving our friends out. Plus, we can't afford to loose the deposit. It's more than the months of rent we have less as we received a major rent reduction.

I'm currently on a Stamp1A (trainee accountant), but I was let go back in Oct as I didn't pass all my exams. I was given and extension to the end of Feb to try and pass the resit, but I could care less. I took the job as I needed one and it was what I could find, plus it helped me to remain in Ireland with my partner. I hoped I would like it, but it was soul draining working at a Big4, and I couldn't focus on anything. Now I'm going into teaching, and as it's next to impossible to get a teaching job in Ireland, I have applied and been accepted on a course in England.

I'm not sure that I would be given permission to remain until June 2010. Plus, I may need to remain until July 2010. It will depend on whether my I'm granted EEA2 or have to get a student visa for the UK. I've gone in before asking about permission to remain as a visitor and was told they couldn't grant this permission, even though I was self-sufficient and had VHi Plan B option. That should've been enough. We figure the EU1 app is the best option. As a partner, I'm only given a 1 yr stamp that has to be renewed every year.

Would it be wise to write in my EU1 app that I'm only looking to remain for 6 months? I'm unsure what to write in my letter.

We submitted out application about 2 weeks ago. Our documents were returned and we were issued a letter for the GNIB for me to receive a 6 month Stamp 4, which was issued without any problems.

As for my EU partner, she had to register with FAS as a jobseeker and submit the registration letter to immigration. Hopefully all will go well and we'll get a Stamp 4EUFAM.

YAY! I'm currently looking for work now. Hope we get a positive result fast. It would definitely be nice to know.
